Public Act No. 22-22 — The Negligent Operation of a Motor Vehicle

Public Act No. 22-22 — The Negligent Operation of a Motor Vehicle
The attack on Public Employees continues. All state employees who operate a state vehicle need to make themselves aware of Public Act No. 22-22, An Act Concerning Damages to Person or Property Caused by the Negligent Operation of a Motor Vehicle Owned by a Political Subdivision of the State.

This bill was recently signed into law and may have widespread unintended impacts. Every public employee who operates a vehicle in the course of their employment (Police, Fire, EMS, Public Works, etc.) are impacted by this new law. When reading this, please don’t confuse immunity with indemnification. While immunity has been legislated away, you will still be indemnified by the state/city/town unless your actions are willful and wanton. Willful and wanton is not the same as negligent.
